Licensing of Patents

The aim of the license of a patent is evidence of the application of technology and profits by reducing the human and the solution of a problem and not by the monetization of the invention. In recent years the market in India has shown a paradigm shift in terms of companies and institutions at the opening of a patent license.

From the technological point of view, market, a company or institution is in a dilemma whether commercialization (licensing or sale) of a patent or not. It's a difficult situation because the income generation through the application of what is at stake or the patent may be used along with other patents to perform a new technology.

It is quite possible that technologies with shorter cycles of innovation could get marketed aggressively and the technology innovation cycles and could not go to a moderate pattern of marketing. In most cases the invention is carried out within the company to maintain the unique selling proposition and differentiation from other products on the market.

As for the parameters that influence the process of patent licensing, the parameters can be internal or external to the organization. Overall classification of the parameters as catalysts and barriers to licensing, the influencing factors are the following:

• Uncertainty and risk involved in a patent license, where new developments would ignore existing patents.
• Practical aspects of developing a business model throughout the life cycle of technology.

In the scenario of India's telecommunications sector is much more open to innovation and investment, so of course technological development are much more aggressive, faster and progress. While in the railway transport sector of the organization is closed to investment, of course, a technological barrier to growth and application.

For a statistical point of view, in the scenario of India, in 2000 the number of patents granted India 557 and the number of patents granted for applications in 2008 were 3173 Indians in India (source india report Patent Office Annual 2009-10).

Anticipating a positive growth in the coming years and more open technology domains of research and development, the Indian market would move to a licensing model driven technological application of an invention - Build - Implement the model of a single organization . This scenario demonstrates a model of co-option of a model of competition driven.
